November 29, 2000

Today the judicial proceedings which has been almost finished (Moiseyev should pronounce concluding remarks) was cancelled and started anew. The formal explanation was, that it should be presided by a new judge Koval. The reason of substitution the judge is unknown yet. May be it is illness of the previous judge. But as the result Moiseyev again had to stay in prison for a long time, being escorted to the court almost every day.

Moiseyev s defense didn t get proper explanation from the court and moved motion to challenge against military prosecutor and full staff of judges. This motion has been declined.

The court took break till December, 1.

December 1, 2000

A new staff of judges: Presiding judge Koval G.N., lay assessors Komarova L.N. and Bugayeva I.T.

The answer to the defense s motion to check the authority of lay assessors was that they had been elected by a session of the Moscow City Soviet and later it had been prolonged (by whom and when was not mentioned).

The complete staff of judges was changed in accordance with the directive of the head of Moscow City Court.

The papers, confirming that the former judge Gubanova has fell ill, were not submitted.

The defense s motion to change measure of suppression was declined as the court doesn t see reasons for it at present time.

It was also mentioned that Moiseyev and his defense would be able to look through the protocol of previous judicial session as it will be preparing (according the law it should be done within three days).

December 6, 2000

Today the defense moved a lot of motions, such as:

- to appoint an extra lay assessor;

- to give some time for familiarizing with protocol of previous judicial proceedings;

These motions were supported by a military prosecutor.

- to demand for original documents;

- to admit representatives of non-governmental organization participate in hearings as the defense;

- to admit Moiseyev s wife to hearings as his defense;

- about open hearing of the case;

- to call additional witnesses from the Ministry of foreign affairs;

- about expert examination in the interdepartmental commission on protecting state secret;

- to exclude proofs obtained in violation of the law.

Military prosecutor didn t agree with these motions.

Judge Koval considered these motions for half an hour and announced her decision to reject them all.

Then the indictment has been announced.

Moiseyev didn t recognize himself guilty.

December 7, 2000

Hearing of Moiseyev s testimony and his interrogation.

December 8, 2000

The defense made a statement about capability of staff of court presiding judge Gubanova, who has been present the day before in the Moscow City Court. They asked to prepare the protocol of the previous judicial session as soon as possible and to give an opportunity to familiarize with it.
