THE CASE OF VALENTIN MOISEYEV

Trial chronicle
september 5-7, 2000

During the period from 5 till 7 of September the judge Gubanova T.K. was considering the following petitions of the defense:

- about hearings at court with Jury
- about the open hearings at court
- release from jail
- admittance to hearings representatives of non government organizations as the defense
- about taking military prosecutor aside from hearings

All the petitions were considered at the closed procedure and finally were declined. In particular the petition about release from jail was declined because of allegation that Moiseyev (who is most of all interested in returning of his good name) could hamper the case consideration and hide from court and also on the connection of seriousness of actions he made.

The petition about taking aside military prosecutor (as all we know Moiseyev is a civil person) who in addition to all received no instruction from the General Procurator s Office to support the accusation in court (just imagine the situation when counsel for the defense comes in court without writ) was declined on infringement of the Law about the General Procurator s Office of RF which says that the execution of functions of the Procurator s Office can be entrusted by the General Procurator with the Military prosecutor s office bodies + in the places where because of the exceptional circumstances others bodies of the Procurator s office of RF do not operate and also beyond the borders of the RF where according to the international agreements the Armed Forces of RF are deployed.
